A BILL to amend article ten-d, chapter five of the code of West
Virginia, one thousand nine hundred thirty-one, as amended,
by adding thereto a new section, designated section eight,
relating to
providing, for the purpose of receiving
retirement benefits, that only the actual number of hours
worked by a retirant who is substitute teaching are counted
when determining the number of days worked.
Be it enacted by the Legislature of West Virginia:
That article ten-d, chapter five of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
eight, to read as follows:
ARTICLE 10D. CONSOLIDATED PUBLIC RETIREMENT BOARD.
ยง5-10D-8. Calculating days worked for retirants engaged in substitute teaching.

Notwithstanding any provision of this code or rule, in
determining if a retirant who accepts employment as a substitute
teacher is a temporary, part-time or substitute employee and
eligible to continue to receive his or her normal monthly
retirement benefit the number of days worked shall be determined
by:

(1) Totaling the number of hours worked; and

(2) Dividing by the standard number of hours that a full-
time teacher works a day.

NOTE: The purpose of this bill is to provide, for the
purpose of receiving retirement benefits, that only the actual
number of hours worked by a retirant who is substitute teaching
are counted when determining the number of days worked.
